CUSTOMER WAIVER

ALIGN SPIN & MOVEMENT INC.

WAIVER AND RELEASE OF LIABILITY

In consideration of my participation and use of the exercise equipment and facilities, I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that ALIGN SPIN & MOVEMENT INC. (further known in this waiver as ALIGN) and its insurers, agents, contractors, vendors, location providers, facility providers, employees, officers, directors, owner, and associates, successors and assigns (collectively, “ALIGN Parties”) shall not be liable for any damages arising from personal injuries (including death) sustained by me on or about the premises, or as a result of the use of the equipment, facilities, or participation in classes, regardless, of whether such injuries result, in whole or in part, from the negligence of ALIGN. By execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type or nature, which may occur to me, and I hereby fully and forever indemnify, hold harmless and release and discharge ALIGN and ALIGN Parties from any and all claims, demands, damages, rights of action or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out of the use of the equipment, facilities, trainers, or instructors. I agree that ALIGN is in no way responsible for the safekeeping of my personal belongings while I attend class.

I warrant and represent that I have no disability, impairment or ailment preventing them from engaging in any form of exercise or activity that will be detrimental to my health or safety or to the health or safety of other participants. I understand that ALIGN is not responsible for my actions or the actions of other participants or guests. If I am in doubt about any part of my fitness training or recreation, I will consult my personal physician before participating. I hereby acknowledge that in using the facilities, participating in classes, programs and equipment, I do so entirely at my own risk. I agree to be solely responsible for any activities I participate in and I assume the risk of injury, including permanent disability or death.

I understand that photos and videos are taken during classes and events from time to time for marketing in all means and media and by all technologies, now known or hereafter devised throughout the universe in perpetuity, social media, and instructional purposes and I hereby consent to their use by ALIGN and waive my right to any compensation for their use.

If any portion of this release from liability shall be deemed by a court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions served here from. This release may not be modified without a written agreement signed by both parties. By signing this release, I acknowledge that I have read the foregoing waiver and release of liability and voluntarily executed this document with full knowledge of its content.

Parental Consent (for participants under the age of 18)

As parent/legal guardian, I hereby consent to have my child participate in ALIGN classes and events. I have read the foregoing waiver and release of liability and voluntarily executed this document with full knowledge of its content. I further agree to indemnify and hold harmless ALIGN Parties from any and all Claims which are brought by, or on behalf of my child and which are in any way connected with my child’s participation.

I HAVE READ AND UNDERSTAND THIS AGREEMENT IN ITS ENTIRETY AND I AM AWARE THAT BY SIGNING THIS AGREEMENT AND CLICKING THE SUBMIT BUTTON ON THIS FORM I AGREE TO BE BOUND BY THIS AGREEMENT AND I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, EXECUTORS, ADMINISTRATORS, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.

THIS AGREEMENT MUST BE COMPLETED IN FULL BY THE PARTICIPANT BEFORE THE PARTICIPANT WILL BE PERMITTED TO PARTICIPATE IN ALIGN ACTIVITIES.
